1. Overview

This website and its services are operated by Scarla Enterprises. By accessing or purchasing from this site, you agree to the following Terms of Service. These terms apply to all users of the site, including browsers, clients, and anyone accessing or using our services. Scarla Enterprises offers Shopify setup, customization, design, and related digital services. These terms are intended to ensure clarity, fairness, and professionalism in every project.

2. Scope of Work

All services are performed according to the details outlined in your chosen package or custom proposal. Each project’s scope, deliverables, and timeline will be confirmed in writing before work begins. Any additional requests outside of the agreed scope may require a separate quote or timeline adjustment.

3. Payment Terms

All projects require an upfront non-refundable deposit before any work begins. The remaining balance is due upon project completion unless otherwise specified in writing. Invoices must be paid in full before final files, site transfers, or credentials are released. Late or non-payment may result in paused services or additional fees.

4. Revisions and Adjustments

Scarla Enterprises strives for full client satisfaction. Each project includes a set number of revisions, as detailed in your service package. Revisions beyond the included limit or major structural changes may incur additional fees.

5. Refund Policy

Refunds are handled in accordance with our Refund Policy. Once work has begun, all payments are considered final, as time and resources are immediately allocated to your project. If an issue arises, I will always do my best to resolve it professionally and ensure your satisfaction.

6. Client Responsibilities

To ensure smooth collaboration, clients agree to provide all required materials (text, images, branding) before the project start date, respond to communication and feedback requests in a timely manner, and verify all information provided for accuracy before final approval. Scarla Enterprises is not responsible for delays caused by missing materials or unresponsiveness.

7. Intellectual Property

All materials, code, images, and documents created by Scarla Enterprises remain the intellectual property of Scarla Enterprises until full payment is received. After final payment, ownership of the completed Shopify design or deliverables is transferred to the client. Templates, tools, and training materials provided (including custom PDF guides) are for the client’s personal use only and may not be redistributed, resold, or copied.

8. Use of Work for Portfolio

Scarla Enterprises reserves the right to display completed projects or design previews in its portfolio, website, or promotional materials, unless otherwise agreed upon in writing before the project begins.

9. Communication

All official communication regarding your project should occur via email at contact@scarlaenterprises.com. Business hours are typically Monday–Friday, 9 AM–5 PM (EST). Messages received outside of these hours will be addressed as soon as possible during regular business times.

10. Liability

Scarla Enterprises is not responsible for any indirect, incidental, or consequential damages arising from the use or inability to use our services, including but not limited to lost profits, business interruptions, or technical issues resulting from third-party apps or hosting.

11. Third-Party Tools and Services

Some services may involve third-party apps, themes, or integrations. Clients are responsible for reviewing and maintaining any external subscriptions or licenses related to these tools.

12. Termination of Services

Either party may terminate a project before completion. If terminated by the client after work has begun, payment for all completed work remains due. If terminated by Scarla Enterprises for reasons outside of client control, any unused portion of the payment may be refunded.

13. Governing Law

These Terms of Service are governed by the laws of Quebec, Canada, without regard to conflict-of-law principles.

14. Changes to Terms

Scarla Enterprises reserves the right to update or modify these Terms of Service at any time. The latest version will always be posted on this website. Continued use of the site or services after changes are made constitutes acceptance of the new terms.
